Are purchased insurance leads legal to call?

Yes, with conditions. Federal law permits manually dialed, live-voice marketing calls to consumers whose numbers are not on the Do Not Call registry (or your internal DNC list). What purchased data never permits: prerecorded or AI voice, ringless voicemail, or marketing texts, because those require written consent the data does not carry. The lane is narrow but real, and it’s the lane every DAITA DRIVE file is built for.

What we will never tell you

Vendors who say those things are the reason agents end up as defendants. Manual dial, live voice, scrubbed file: that’s the lawful lane, and our contracts require it because it protects you as much as us.

Who is liable if I call a number on the Do Not Call list?

The caller carries primary liability: $500–$1,500 per call in statutory damages once a consumer receives two violating calls in 12 months. That’s why every DAITA DRIVE file arrives pre-scrubbed and why buyers maintain their own DNC subscription and re-scrub every 31 days. Belt and suspenders, both required.

What is a litigator scrub?

Can I text the leads I buy?

No. Marketing texts require prior express written consent, and purchased data doesn’t carry it. Several states treat texts exactly like calls under their telemarketing laws. Our contracts prohibit texting DRIVE data, full stop.
